By accessing or using our websites, digital products, consulting services, templates, or any materials provided by Cascada Communications (“Company,” “we,” “our,” “us”), you agree to the following Terms of Service (“Terms”). If you do not agree to these Terms, please discontinue use of our website and refrain from purchasing our services or digital products.

Cascada Communications provides marketing consulting, digital advertising services, web design, automation systems, digital templates, online programs, and related educational resources. Our offerings may be updated or modified at any time.

2. No Guarantees of Results

Your business outcomes depend on many factors outside our control—including market conditions, industry, implementation, budget, team capacity, and consistency. As such, Cascada Communications does not guarantee results or performance outcomes of any kind. Results will always vary.

This includes, but is not limited to:

  • Revenue, profit, or sales outcomes

  • Lead generation or conversion rates

  • Ad performance metrics (CPC, CPM, ROAS, etc.)

  • Website traffic or SEO rankings

  • Client acquisition or retention

  • Any performance-based or financial results

We provide expert strategy, resources, and tools, but implementation and results are ultimately your responsibility.

3. No Refund Policy

Due to the nature of our services and the instant-delivery format of digital products:

ALL SALES ARE FINAL. NO REFUNDS, NO EXCHANGES, AND NO CREDITS WILL BE ISSUED.

This applies to:

  • Digital products and templates

  • Strategy sessions and consulting

  • Website or marketing builds

  • Ongoing retainers

  • Online courses, workshops, or trainings

  • Automation setups or custom systems

  • Any downloadable or access-based product

4. Intellectual Property Rights

All content created or provided by Cascada Communications—including templates, spreadsheets, workflows, documentation, graphics, code, videos, and training materials—is protected by intellectual property law.

Unless explicitly stated otherwise:

  • You receive a non-transferable license for personal or business use.

  • You may not share, resell, redistribute, rebrand, or claim any of our materials as your own.

  • You may not use our intellectual property to create competing products, templates, or courses.

5. Client Responsibilities

To ensure the highest-quality experience, you agree to:

  • Provide accurate information, materials, passwords, and platform access on time

  • Maintain responsibility for all advertising budgets

  • Follow strategic guidance and provide necessary approvals

  • Make final decisions regarding your business

  • Comply with platform policies (Google, Meta, CRM tools, etc.)

Cascada Communications is not responsible for delays or outcomes caused by missing information, denied access, platform interruptions, or client inaction.

6. Payment Terms

You agree to pay all fees associated with your purchase or service agreement.

  • Payment is due in full unless otherwise stated.

  • Payment plans, when offered, must be completed in full.

  • Failed payments may result in suspension of access or services AND additional fees.

Chargebacks or payment disputes will result in immediate suspension of services and may initiate legal action due to breach of these Terms.

7. Disclaimer

All services, guidance, and digital products are provided for educational, strategic, and informational purposes only.

We do not guarantee:

  • Performance benchmarks

  • Consistent behavior of third-party platforms (Google, Meta, hosting services, etc.)

  • Specific marketing, financial, or operational results

Your use of our services and digital products is at your own discretion and risk.

8. Limitation of Liability

To the maximum extent permitted by law:

  • Cascada Communications is not liable for any indirect, incidental, or consequential damages.

  • We are not responsible for lost profits, lost data, business interruptions, or platform-related issues.

  • Our total liability shall not exceed the amount you paid for the specific service or product.

9. Confidentiality

Both parties agree to maintain confidentiality of sensitive, proprietary, or private information unless required by law.

10. Termination

We reserve the right to terminate services if a client violates these Terms, behaves inappropriately, or fails to provide necessary access or materials.

No refunds will be issued for terminated agreements.

11. Governing Law

These Terms are governed by the laws of the State of Utah (or your chosen state). Any disputes will be handled through binding arbitration or small claims court.

12. Changes to These Terms

We may modify or update these Terms at any time. Any updates will be posted with a revised “Last Updated” date.
